Terms of Service

These Terms govern your use of every TradeHouse product. By using any TradeHouse product you agree to these Terms.

T1. Nature of the Service (Pattern-A core)

The Service provides impersonal market data and generic, standardized software tools and research. The Service does NOT provide investment, financial, legal, or tax advice; does NOT make individualized or personalized recommendations; does NOT manage, custody, or direct any customer account; does NOT receive transaction-based compensation; and does NOT tailor any output to any customer's identity, portfolio, holdings, or financial circumstances. Strategy templates, datasets, and tools are standardized and identical across all customers. Nothing in the Service is a solicitation, recommendation, endorsement, or inducement to buy, sell, or hold any security, futures contract, event or prediction-market contract, swap, digital asset, or other instrument. The customer acknowledges the Service is a research and informational tool only.

T2. Customer Acknowledgement

By using the Service the customer represents, warrants, and acknowledges that: (a) the customer is solely responsible for all of the customer's own trading and investment decisions; (b) the customer is not relying on TradeHouse for advice and understands TradeHouse gives none; (c) the customer understands all performance figures shown are hypothetical, historical, or illustrative and are not a prediction or guarantee; (d) the customer understands trading involves substantial risk including total loss of capital; (e) the customer will, if appropriate, consult the customer's own licensed financial, legal, and tax advisers; (f) the customer is using the Service for the customer's own account and not to provide advice to third parties without independent authorization to do so.

T3. No Advisory Relationship

No fiduciary, advisory, brokerage, agency, or trust relationship of any kind is created between TradeHouse and the customer by use of the Service. TradeHouse owes the customer no duty of care, suitability, best-interest, or loyalty in respect of any trading or investment decision.

T4. Disclaimer of Warranties

THE SERVICE, ALL DATA, ALL TEMPLATES, AND ALL OUTPUT ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. TRADEHOUSE DOES NOT WARRANT THAT ANY DATA OR RESULT IS ACCURATE OR THAT ANY STRATEGY WILL BE PROFITABLE.

T5. Limitation of Liability; Trading-Loss Waiver; Damages Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEHOUSE AND ITS AFFILIATES, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TRADEHOUSE'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) THE TOTAL FEES PAID BY THE CUSTOMER TO TRADEHOUSE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED US DOLLARS. THE CUSTOMER EXPRESSLY WAIVES ANY CLAIM FOR TRADING OR INVESTMENT LOSSES.

T6. Indemnification

The customer shall indemnify and hold harmless TradeHouse and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from the customer's use of the Service, the customer's trading decisions, or the customer's breach of these Terms.

T7. Binding Individual Arbitration; Class-Action Waiver

Any dispute arising from or relating to the Service shall be resolved by BINDING INDIVIDUAL ARBITRATION administered by a recognized arbitration provider, seated in the governing-law jurisdiction. THE CUSTOMER AND TRADEHOUSE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Each party bears its own arbitration costs except as the arbitrator orders. A customer may OPT OUT of arbitration by written notice to TradeHouse within 30 days of first acceptance of these Terms.

T8. Governing Law and Venue

These Terms are governed by the law of the State of incorporation of the TradeHouse revenue entity, without regard to conflict-of-laws rules. Exclusive venue for any non-arbitrable matter lies in that jurisdiction.

T9. Severability

If any provision of these Terms is held unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force. In particular, the unenforceability of the class-action waiver shall not void the agreement to arbitrate, and vice versa, only to the extent permitted by applicable law.

T10. Eligibility and Jurisdiction

The Service is offered only to customers in jurisdictions where it is lawful to do so. The customer represents the customer is legally permitted to use the Service and to trade the relevant instruments in the customer's jurisdiction. TradeHouse may geo-restrict or decline service. The customer represents the customer is at least 18 (or the age of majority).

T11. No Redistribution

The customer may not resell, redistribute, scrape, or sublicense any data, dataset, template, or output except as expressly permitted by the customer's tier. Data is sourced from TradeHouse's own trading operations and public on-chain sources; the customer obtains a limited license, not ownership.

T12. Modification and Termination

TradeHouse may modify the Service or these Terms with notice; continued use after the effective date constitutes acceptance. TradeHouse may suspend or terminate access for breach. Material adverse Terms changes give the customer a right to cancel for a pro-rata refund.

TradeHouse provides impersonal market data and generic, standardized research and software tools. TradeHouse is NOT an investment adviser, NOT a commodity trading advisor, NOT a broker-dealer, and NOT a registered or licensed financial professional of any kind. Nothing provided by TradeHouse is investment, financial, legal, accounting, or tax advice, a recommendation, or a solicitation to buy, sell, or hold any security, futures contract, event contract, swap, token, or other instrument. TradeHouse does not provide individualized advice, does not manage or direct any account, does not know your financial situation, and does not tailor any output to any person. The same data, tools, and standardized templates are provided to every customer. You are solely and exclusively responsible for your own trading and investment decisions and for evaluating any output yourself or with your own licensed advisers. Trading prediction markets, securities, futures, and digital assets involves substantial risk, including the total loss of capital. Past or hypothetical results do not indicate or predict future results.
